The information we obtain in this way or provided when you access our website may include time of visit, pages viewed and time spent on each page of the web pages; referring site details (such as website name, search engine name, social network name, etc.); web browser type; browser language; operating system type; Flash version, JavaScript support, screen resolution and screen color processing ability; network location and IP address; file downloads; clicks on external links as well as videos on the website; form submission errors; scroll depth; interaction with website widgets; geolocation information, submitted order and its associated data and files, any submitted information and its associated data and files.

You may share Customer Content with us, use the Digital Menu Platform, place orders and use all features offered on the Website/App, and subject to KYC and applicable regulatory requirements. “Customer Content” means all data and materials provided by Customer to akafco for use in connection with the Digital Menu Services, including, but not limited to, any Customer applications, information, data, files, databases, charts, images, tables, analyses, menus, text, numbers, corporate information, financial information, personally identifiable information of administrators/users or any other information or data owned or controlled by Customer.

By voluntarily providing us with your personal information, including but not limited to, using the Website or registering as a user on the AKAF Digital Menu Platform, you expressly and irrevocably consent to our use of your personal information in accordance with this Privacy Policy. If you provide us with your personal information, you acknowledge and agree that such personal information may be transferred from your current location to the Website servers and servers of authorized third parties, which may be located in various locations.

This End User License Agreement (“EULA”) is a legal agreement between you and us, “AKAF Investment & Integrated Projects LLC”.

This End User License Agreement (EULA), together with the terms and conditions set forth at https://www.akafco.com/Privacy-Policy/, governs your use of our AKAF Digital Menu application, which is available from any media (the “Application”) directly from akafco or indirectly through an authorized akafco reseller or distributor (“Seller”). Please read this AKAF Digital Menu Application License Agreement carefully before completing the installation or registration process and using the AKAF Digital Menu Application, even evaluating it for a free trial period. This Agreement provides a license to use the AKAF Digital Menu Application and contains warranty information and disclaimers. By clicking “Accept” or installing and/or using the AKAF Digital Menu Application, you acknowledge and agree to the terms of this Application License Agreement, together with the Privacy Policy ( https://www.akafco.com/privacy-policy/).

By installing or accessing the Application through any means, you represent that you have the authority on behalf of a natural person or other legal entity to bind that person and its affiliates to this EULA. If you do not have such authority or do not agree to the terms and conditions of this EULA, do not install or use the Application and you should not accept this EULA. This Agreement applies only to the Software provided by akafco herein, regardless of whether other Software is referenced or described herein. Grant of License: akafco hereby grants you a personal, non-transferable, non-exclusive, and limited license to use the AKAF Digital Menu App on your devices subject to the terms of this EULA. You are authorized to download or open the AKAF Digital Menu App on a device or browser (e.g., laptop, desktop, mobile, or tablet) under your control. You are responsible for ensuring that your device meets the minimum requirements for the AKAF Digital Menu App.

You are not allowed to:

• Edit, modify, reverse engineer, modify, adapt, translate or otherwise alter the whole or any part of the Program, or permit the combination or incorporation of the whole or any part of the Program with any other program, or disassemble, disassemble or reverse engineer the Program, or attempt to do so.
• Reproduce, copy, distribute, resell or use the App for any commercial purpose, unless expressly agreed to between you and akafco.
• Allow any third party to use the program on behalf of or for the benefit of any third party, except to allow claimants and EOI applicants to register and apply for claims and submit expressions of interest.

• Use the Application for any purpose that akafco deems to be in violation of this EULA.
• Conduct or promote any illegal activity while using the App;
• Upload, distribute or print anything that may be harmful to minors;
• Post any material that violates or infringes the rights of others, or is illegal;
• Transmit any information that we, in our sole discretion, deem to be offensive, excessively violent, harassing, defamatory, vulgar, obscene, lewd, lascivious or otherwise objectionable;
• Attempt to reverse engineer or compromise the proper functioning of the AKAF Digital Menu application, or attempt to extract the source code of the software (including tools, methods, processes and infrastructure) that enables or underpins the application.
• Attempt to access secure areas of the App to which you are not authorized or obtain or attempt to obtain any materials, content or information through any means not intentionally made available or provided through the App or its services; upload or transmit any viruses, worms, Trojan horses or other malicious code;
• Use the App in a manner that may cause unsolicited email advertising or spam;
• Use any automated or manual process to search for or extract information from the App, or interfere with the proper functioning of the App in any way;
• Use the Program in any manner that could disable, overburden, damage, or impair the Program or interfere with any other person’s use and enjoyment of the Program;
• Impersonate another user or an employee of akafco, or its partners or providers;
• “Frame”, inline link or similar display of the App’s content or features without the express prior written permission of an authorized representative of akafco; or promote any services, offers or brands through the App’s communication center through any advertisements, iframes, hyperlinks, inline links, etc., unless expressly permitted by an agreement between you and akafco.
• Exploit any bug, weakness, or security or performance hole for the benefit of anyone, including yourself.
• Do not publish or share with anyone any bugs, weaknesses or vulnerabilities identified on social media platforms or in face-to-face interactions, unless you share it with akafco and its authorized representative.
• Co-brand this Application without the express prior written permission of an authorized representative of akafco. For purposes of these Terms of Use, “co-branding” means displaying the name, logo, trademark or other means of attribution or identification of either party in a manner that reasonably suggests to a user that the other party has the right to display, publish or distribute this Application or the content accessible in this Application.

You agree to cooperate with akafco in the event of a breach of these Terms to remedy the breach or violation.

We are an enabling platform and our services cannot be considered as creating an agency. Any services such as those related to the delivery of food and/or beverages, its preparation/ingredients or anything incidental thereto shall be solely the responsibility of the restaurant or food service. There is no attorney-client/legal professional relationship between you and us at any time.

Our App, including any automated online metrics and annotations, any articles or links thereto, or documents generated through the App, do not constitute advertising, solicitation, or legal advice. The App, the content available on or through the App, and the documents contained in the App are not a substitute for the advice of a legal or other professional or licensed professional. You should not rely on the App or the App Documents for any purpose without seeking professional advice from a licensed professional in the relevant jurisdiction.

We do not intend to advertise to or otherwise solicit customers in jurisdictions where our services are not permitted by law, and the Program and documents generated in this Program do not constitute any advertising or solicitation. Refund/Cancellation Policy – Since all customers are given a trial period before upgrading, we do not have a cancellation or refund policy. If you deactivate your account, any payment made for the trial period will be forfeited.
